Qualifying questions for Spain's digital nomad visa

The main applicant needs to be able to answer YES to each of these questions:

  1. Do you earn enough income for you and your dependent? (see table below)
  2. Is your work fully remote?
  3. Do you have a relevant degree? If not, can you prove 3 years' experience with tax or social security documents?
  4. Are you willing to become tax resident and spend at least half the year in Spain?
  5. Do you have a clean criminal record?

Then there are 2 options:
Self-employed — the most popular as it's the easiest;
Employed — usually limited to those from a specific list of countries;

Self-employed/freelancer/contractor

You need to answer YES to the following questions:

  1. Do you have long term contracts that have been in place for at least 3 months that are with businesses?
  2. Are your clients happy to write a letter authorising you to work from Spain?
  3. Are your clients registered businesses who have been in existence for at least one year?
  4. Can you prove via tax or social security documents that you are registered as self employed in the country you are coming from if asked.
  5. Are you willing to register as self-employed in Spain IMMEDIATELY the permit is granted and pay your tax and social security here? See here for approx. rates: https://autonomoinfo.com/en/

Employed

You need to answer YES to the following questions:

  1. Are you from the UK, Russia, Canada or USA? If not, your employer will need to register in Spain to pay employer's social security (Approx. set up costs 2,000 euros, plus approx. 32% of your salary in employer's social security on the first 59,000 euros).
  2. If you are from the 4 countries mentioned above and using a certificate of coverage, is your employer happy to write a letter saying they are sending you if this is requested?
  3. Have you worked for your employer for a least 3 months and is the contract long-term or indefinite?
  4. Is your employer happy to write a letter authorising you to work from Spain?
  5. Is your employer a registered business that has been in existence for at least one year?

Contrary to common belief, the Beckham tax regime is not open to all DNV holders. Self-employed professionals or those who hold more than 25% ownership in their company typically do not qualify. Always obtain independent tax advice, especially as a business owner, as you may risk creating a permanent establishment in Spain.

  5. Any criminal record check that is not clean may result in a denial by the UGE.
